Plaintiff, Jennifer Nunez, has filed a lawsuit under the Fair Labor Standards Act (FLSA), a federal law that protects workers’ rights to receive full pay, including tips they have earned. The case involves Ryan Sanders Sports Services, LLC, doing business as RS3 Strategic Hospitality, a company that provides catering and food services at sports venues like Dell Diamond in Round Rock, Texas.

The lawsuit claims that RS3 required servers, bartenders, and concession stand workers to participate in a tip pool but then illegally kept part of those pooled tips for itself. Under the FLSA, employers are not allowed to retain any portion of tips earned by employees who customarily receive them.

The plaintiff alleges that RS3 withheld tips in violation of federal law. She, on behalf of herself and others, is seeking recovery of those unpaid tips, liquidated (double) damages, and reimbursement of attorney’s fees and court costs.
