Ryan Sanders Sports Services d/b/a RS3 Strategic Hospitality
Plaintiff, Jennifer Nunez, has filed a lawsuit under the Fair Labor Standards Act (FLSA), a federal law that protects workers’ rights to receive full pay, including tips they have earned. The case involves Ryan Sanders Sports Services, LLC, doing business as RS3 Strategic Hospitality, a company that provides catering and food services at sports venues like Dell Diamond in Round Rock, Texas.
The lawsuit claims that RS3 required servers, bartenders, and concession stand workers to participate in a tip pool but then illegally kept part of those pooled tips for itself. Under the FLSA, employers are not allowed to retain any portion of tips earned by employees who customarily receive them.
The plaintiff alleges that RS3 withheld tips in violation of federal law. She, on behalf of herself and others, is seeking recovery of those unpaid tips, liquidated (double) damages, and reimbursement of attorney’s fees and court costs.
The lawsuit applies to all servers, concession stand workers, and bartenders who worked for RS3 at any time in the past three years and were required to share their tips.
Am I eligible?
You may be eligible if you worked as a server, bartender, or concession stand worker for RS3 Strategic Hospitality in the last three years. Contact Carina Hopkins at (512) 379-5981 or [email protected] to confirm your eligibility.
Which locations are included?
All RS3 Strategic Hospitality job sites, such as Dell Diamond and other sports venues where food and beverage service was provided, are included. If you worked in a tipped role at any RS3-operated location, you may qualify.
How do I make a claim?
To join the case and make a claim, you need to sign a consent form.
What timeframe does this matter cover?
There is a statute of limitations which allows workers to recover unpaid wages within specific time periods. Under federal law, the statute of limitation is two to three years back from when we file your Consent form. If you were employed by RS3 Strategic Hospitality at any time within the past three years, you may have a claim.
Do I have to pay anything?
No. This case is handled on a contingency fee basis, which means the attorneys are only paid if there is a recovery, and their fees come out of the settlement—not from you directly.
How do I prove I worked there or was missing tips?
You do not need to have records yourself. The law requires the employer to keep those records. The legal team will request them from RS3 Strategic Hospitality. If you do have documents (pay stubs, schedules, etc.), please hold onto them, but not having them won’t prevent you from joining.
Can I be retaliated against for making this claim?
No. It is illegal for RS3 Strategic Hospitality to retaliate against you for joining this case. If you experience any retaliation, contact Carina Hopkins at (512) 872-3448 immediately.
How long will this take?
Depending on the complexity of the case, similar cases can take anywhere from one to three years, depending on the court schedule and how the company responds.
Is there money available now?
No. This case is ongoing, and no money is available at this stage. Joining the case gives you the opportunity to receive compensation if a settlement or judgment is reached.
How can I help?
If you know others who worked in tipped positions for RS3 Strategic Hospitality, please encourage them to get in touch. They can contact Carina Hopkins or complete the online consent form to join the case.
I have additional questions.
You can reach Carina Hopkins at (512) 872-3448 or [email protected] for any other questions or concerns.
